Terms and conditions
1. Who we are
SK Residential is a trading name of S&K Property Investments and Improvement Ltd, a company registered in England and Wales (company number 16932889), registered office Unit 1 Hembs Crescent, Great Barr, Birmingham B43 5DG. In these terms “we” and “us” mean S&K Property Investments and Improvement Ltd.
2. This website
Information on this website, including guide prices and guides, is general and for information only. Guide prices are ranges for typical projects and are not offers. Images are computer-generated illustrations, not photographs of our completed work.
3. Quotes
We give a written quote after a site visit. It sets out the drawings and specification it is based on, what is and is not included, VAT, the programme and the payment schedule. A quote is valid for the period stated on it.
4. The contract
A contract is formed when you accept our written quote in writing and we confirm acceptance. Your contract is with S&K Property Investments and Improvement Ltd. Work is carried out by our teams and by trade contractors working under our contract with you; we remain responsible to you for the work.
5. Changes
If you or we want to change the specification, we price the change in writing and only carry it out once you agree it. Unforeseen conditions, such as hidden structural defects or unexpected drains, are discussed with you before any extra work is done.
6. Payments
Payments are due as set out in the payment schedule in your quote and contract. We will not ask for payment for work that has not been agreed in writing.
7. Your right to cancel
If you enter into the contract at your home or away from our premises, or online, you normally have the right to cancel within 14 days without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you ask us to start work during the cancellation period and then cancel, you must pay a proportionate amount for the work done up to the point you told us you were cancelling. The Regulations do not apply to contracts for building new homes or creating substantially new buildings by converting existing ones; for those contracts any cancellation right is set out in the contract itself. Goods made to your specification, such as made-to-measure glazing or a bespoke kitchen, may not be returnable once ordered with your agreement. We will give you a cancellation form with your contract.
8. Approvals
Where the contract includes them, we prepare and submit planning, permitted development, building regulations or building warrant applications and party wall notices. Council and surveyor fees are listed in the quote. We cannot guarantee the outcome of a planning application.
9. Your responsibilities
You agree to give access to the property at the agreed times, provide water and electricity for the works, tell us about anything you know that may affect the work (such as easements, restrictive covenants or previous planning conditions), and make decisions on finishes in time for the programme.
10. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law. Your statutory rights under the Consumer Rights Act 2015 are not affected.
11. Complaints
If something is not right, tell us as soon as possible by phone or email so we can put it right. We aim to respond to complaints within 10 working days.
12. Law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
